CLASS ACTION CASES

Our automotive law center has filed some of the most important class action cases in the automotive industry. These include:

Gregg Klein v. Volkswagen Group of America, Inc. (Case No. 2:15-cv-07570) – A national class action case against Volkswagen for the diesel emissions cover-up. Volkswagen has admitted that its diesel engines emit up to 40 times the amount of nitrogen oxides than are legally permitted. Nitrogen oxide gasses are the chief cause of smog and acid rain, and are responsible for a variety of health problems, including reduced lung function and asthma attacks.

Martin Ponce v. General Motors (Case No. CV14-2161) – A national class action case against General Motors for its ignition switch fraud. GM has admitted that the faulty ignition switch has caused consumers to die. The company initially claimed that the defect is responsible for 12 deaths, but following the lawsuit it admitted to killing over 100 consumers. After initiating the General Motors class action, we were involved in the Congressional Hearings where chief executive Mary Bara was summoned to testify, and our founding member Jonathan Michaels was nominated for a Pulitzer Prize in Journalism for his work on the recall scandal.

Jacob Sabatino v. Uber Technologies, Inc. (Case No. 3:15-cv-00363) – A California class action case against Uber for false advertising and fraudulent business practices. The lawsuit alleges that Uber made numerous misrepresentations about the safety of its ride-share services, including falsely claiming that it conducts “industry-leading” background checks on its drivers.

Latoya Lumpkin v. Chrysler Group LLC (Case No. 3:15-cv-00363) – A California class action case against Chrysler for defective ignition switches in the company’s Jeep Grand Cherokee and Commander vehicles.

MAKING NEW LAW

In June 2009, Chrysler terminated 789 dealers as part of its bankruptcy reorganization process.  The dealers, many of whom had been with the manufacturer for generations, were given just 22 days to cease all business operations, leaving many of them with heavy financial obligations, such as mortgages or leases, that could not be met.  The terminations were part of the 2008 Troubled Asset Relief Program (TARP), where the U.S. provided Chrysler with $12.5 billion in financial assistance.  The dealers were paid nothing for the loss of their businesses.

In 2012, our office filed a lawsuit against the U.S. on behalf of several of the terminated Chrysler dealers, in the case of Spitzer v. the U.S. (Case No. 12-900 L). The lawsuit alleges that the government took the dealers’ property without providing just compensation, in violation of
the 5th Amendment.

In an emergency appeal by the government to the U.S. Court of Appeal, the court ruled in favor of the dealers. The court also signaled that the case may be headed to the U.S. Supreme Court, stating “the facts of this case are unique and raise issues that have not been decided before.”

DEALER-MANUFACTURER LITIGATION

One of the main focuses of our automotive law center is representing new car dealers against auto manufacturers in major franchise disputes. We have litigated cases against manufacturers in state court, federal court and administrative law proceedings throughout the U.S.

Our dealer-manufacturer litigation has involved claims of breach of contract, fraud, negligence, RICO, conspiracy, unfair business practices, vehicle code violations and concealment.

AUTOMOTIVE BUSINESS TRANSACTIONS

We handle business transactions of all sorts, including buy-sells, franchise agreements, distribution agreements, PPMs, mergers and acquisitions, sponsorship agreements, joint ventures, capital raises, UPREITs and land acquisitions. We also offer guidance in matters of corporate governance and corporate formation, and are available to serve as outside general counsel.

The lawyers in our automotive law center are admitted to practice in California, Colorado, the U.S. District Court for the Southern, Central and Northern Districts of California, the U.S. District Court for Eastern District of Michigan, the U.S. Court of Federal Claims, the U.S. Court of Appeals for the 9th Circuit, the U.S. Court of Appeals for the 6th Circuit, the U.S. Court of Appeals for the Federal Circuit, and the U.S. Supreme Court.
